PRIVACY POLICY

This policy explains what the Phyzseek mobile application and website (together, the "Phyzseek Service") collect, why, who can see it, and what control you have. The Service is operated by WellFit Holdings LLC ("WFH", "we", "us"), 6231 PGA Blvd., Suite 104-168, Palm Beach Gardens, FL 33418.

Three things worth knowing before the detail.

Phyzseek is a comparison product. Some of what you record is deliberately visible to other members — that is the point of leaderboards and competitors. Section 4 sets out exactly what they can see.

We do not sell your personal information, and we do not show advertising. There is no advertising software in the app.

Some of what Phyzseek records about you — your body measurements, your heart rate, the results you record and the runs you track — is consumer health data under Washington State law. 1. INFORMATION YOU GIVE US

Account. Your email address and a password, which we store only as a cryptographic hash and cannot read.

Profile. Your first and last name, date of birth, sex, body weight, height, resting heart rate, an optional maximum heart rate, your fitness level, your time zone, the equipment you have available, your preferred cardio type, and a profile photo if you add one.

We ask for date of birth, sex and body weight because the app uses them to calculate your heart-rate zones, your calorie estimates and your age bracket for rankings. Without them those figures are either unavailable or less accurate.

2. INFORMATION THE APP RECORDS AS YOU TRAIN

Workout results. Which workout you did, when, your time, reps or rounds, calories, and your ranking against other members. Interval workouts record one row per cycle.

Heart rate. If you connect a Bluetooth heart-rate monitor, or enable Apple Health, the app records your heart rate through the workout — as a series of readings at five-second intervals — together with your average and maximum, your intensity, and your recovery in the minutes after you finish.

Runs. For an outdoor run the app records distance, duration, per-mile splits, pace, an indicator of GPS coverage, and optionally the temperature. Indoors, where there is no GPS, it records time only, and you may type a distance yourself.

Location. Location is used in two narrow ways.

For a run, your device's GPS is used to measure distance and splits. The route itself is not sent to us or stored on our servers; what we store is the resulting distance, splits and coverage figure.

For the optional temperature on a run, your device — not our server — looks the weather up directly, and it rounds your position to roughly one kilometre before doing so. We never receive the coordinate.

Separately, when you complete a workout the app records a single coarse position, rounded to roughly 110 metres, so that we do not send you a notification about a competitor who trained in the same place as you at the same time. It is stored with that workout record and used for nothing else.

PhytTest. Your results on the standardised fitness test.

Device token. If you turn notifications on, a token that allows Apple to deliver push notifications to your device.

Purchases. A record of your subscription — which plan, when it renews, whether it has been cancelled — supplied to us by Apple. We never receive or store your payment card details.

3. APPLE HEALTH

If you enable Apple Health, the app reads heart rate and active energy recorded during your workouts. We use that data only to show and store your workout metrics as described above.

We do not use Apple Health data for advertising, we do not sell it, and we do not share it with third parties or use it for any purpose other than your fitness records in Phyzseek. You can withdraw access at any time in the Health app.

4. WHAT OTHER MEMBERS CAN SEE — READ THIS SECTION

Phyzseek ranks members against each other, so some of your information is visible to other signed-in members.

Your profile card shows your name, profile photo, age, fitness score, the number of workouts you have completed, and your body weight. It is shown to any signed-in member who finds you — including through a search by name, which any member can perform.

If you would prefer your body weight not to be visible to other members, do not enter it. The app will then show fewer calorie figures, because the calculation needs it.

Leaderboards and comparison boards show your name, age and results alongside other members'.

Competitors see your results on workouts you have both done. A competitor connection requires both people to accept, and either of you can remove it.

Your email address, password, height, resting heart rate, location, heart-rate recordings and subscription details are never shown to other members.

5. HOW WE USE INFORMATION

To operate the Service: to run the workouts, calculate and store your results, rank them, and show your history.

To communicate with you: to send workout reminders you have asked for, notifications about competitor activity, and service messages about your account or subscription.

To improve the Service: to understand how it is used and to fix problems, using aggregated or de-identified information wherever that is sufficient.

To keep it honest: to detect results that appear fabricated, and to enforce our Terms of Use.

We do not use your information to build advertising profiles, and we do not sell it.

6. WHO WE SHARE INFORMATION WITH

Other members, as described in section 4.

Apple, which processes subscription payments and delivers push notifications. Apple's handling of your payment information is governed by Apple's own privacy policy.

Amazon Web Services, which hosts the Service. Your data is stored on servers in the United States.

Open-Meteo, which supplies weather data. It receives a position rounded to roughly one kilometre, sent by your device, with nothing identifying you or your account.

We may also disclose information if required by law, to enforce our Terms, or to protect the rights or safety of any person. If WFH is involved in a merger, acquisition or sale of assets, your information may transfer as part of it; we will tell you before it becomes subject to a different privacy policy.

We do not sell personal information, and we have not done so.

7. RETENTION AND DELETION

We keep your information for as long as your account exists.

You may delete your account at any time, from Settings in the app, or by emailing support@phyzseek.com. Deleting your account permanently removes your personal information: your name, email address, profile photo, date of birth, sex, body weight, height and heart-rate settings, together with your competitor connections, your device registration, anything you have posted and any photographs you uploaded. Deletion cannot be undone and we cannot restore a deleted account.

Your recorded workouts, runs, heart-rate recordings and test results are not deleted. We keep them because every member’s standing is measured against everyone who has done the same workout, so erasing one member’s history would change other members’ results. Your name, email address, photograph, date of birth and the other details that identify you are removed, those records are no longer shown to you or to any other member, and they are not presented under your name anywhere in the Service. We do not attempt to re-identify them, and we are continuing to reduce the information kept alongside them.

Some information may remain for a limited period in encrypted backups, and we may retain records we are required by law to keep, such as transaction records.

8. SECURITY

We protect your information with measures including encryption in transit, hashed passwords, and access controls limiting who can reach production data. No system is perfectly secure, and we cannot guarantee absolute security, but we take this seriously and we will notify you of a breach affecting your personal information where the law requires it.

9. MINORS

The Phyzseek Service is not intended for anyone under 18, and we do not knowingly collect personal information from them. If you believe someone under 18 has given us information, contact us and we will delete it.

We rely on the date of birth given at registration to apply this limit. If we learn that an account belongs to someone under 18, we will close it and delete the personal information held for it.

10. YOUR CHOICES AND RIGHTS

Access and correction. You can see and change your profile information in the app at any time.

Deletion. You can delete your account and its data as described in section 7.

Notifications. You can turn push notifications and workout reminders on or off in Settings, and switch them off entirely in your device settings.

Location. You can decline or withdraw location permission in your device settings. Runs will then record time only, with no distance or splits.

Apple Health. You can withdraw access at any time in the Health app.

Marketing email. Any marketing email we send will include a way to unsubscribe. We will still send messages necessary to operate your account.

Depending on where you live, you may have additional rights — including to a copy of your data, to correct it, to delete it, or to object to certain processing. Write to us at the address below and we will respond as the law requires. We will not treat you differently for exercising a right.

11. INTERNATIONAL USERS

The Phyzseek Service is offered in the United States only. It is operated from the United States and your information is stored and processed there. We do not offer the Service to residents of the European Union or the United Kingdom, and it has not been designed to meet the requirements of the General Data Protection Regulation. If you access the Service from outside the United States you do so on your own initiative, and your information will be transferred to and processed in the United States, where privacy laws may differ from those in your own country.

12. CHANGES TO THIS POLICY

We may update this policy. When we do, we will change the date at the top and make the new version available in the app. If a change is material we will make reasonable efforts to notify you.
